Doctor Nandipha Magudumana has lost her battle to declare her arrest and deportation from Tanzania unlawful. Judgment on her urgent application was handed down in the Free State High Court in Bloemfontein on Monday morning. Magudumana has been ordered to pay the legal fees for the counsel representing the director of public prosecutions in the Free State, an investigating officer with police and the Home Affairs minister. According to a source within the legal fraternity, Magudumana could be slapped with a bill of anywhere between R200,000 and R300,000. Magudumana has two options: appeal the decision or apply for bail.
Melusi Xulu believes Magudumana has two options: appeal the decision or apply for bail. Magudumana will appear with Bester and their six co-accused in court on 20 June.
The Home Affairs Department began cancelling Nandipha Magudumana's passport in May.
On Monday, Minister Aaron Motsoaledi updated the identification documents of rapist and murderer Thabo Bester and his accomplice, Magudumana.
Following Bester's daring escape from the Mangaung Correctional Centre last year, the couple was deported from Tanzania and apprehended.
According to Motsoaledi, the decision to withdraw Magudumana's passport was made following the South African Passports and Travel Documents Act.
If the person has been deported and brought to the country at the state's expense, you are aware that we had to hire that chartered flight at our cost for R1.4 million, and the law is apparent in that regard.
