Councilor Makwarela was dismissed after providing a letter of solvency to the municipality.
The City released a statement: "The City Manager, Mr Johann Mettler, has received a notice of solvency rehabilitation from Cllr Murunwa Makwarela this morning, and has subsequently informed the Gauteng Provincial Electoral Officer of the Independent Electoral Commission (IEC) to immediately withdraw the declaration of a vacancy for the Congress of the People (COPE) proportional representative (PR) councillor.
“The IEC has confirmed receipt of the letter from the City Manager for the withdrawal of the vacancy declaration and undertook to process it accordingly, as they are still within the 21-day time limit,”
A person who has been pronounced an unrehabilitated insolvent is not allowed to serve as a councillor, according to the Constitution.
The disqualification was based on Sections 158(1)(c) and 47(1)(c) of the 1996 Constitution of the Republic of South Africa. The disqualification was also in accordance with Schedule 1, Section 19(c) and (d) of the Local Government: Municipal Buildings Act, 1998. (Act 117 of 1998).
Johann Mettler, the city manager, has informed the Gauteng Independent Electoral Commission of the mayoral vacancy. Makwarela was elected mayor with the backing of the ANC and the EFF last month.
